Waiver / liability release

I agree to participate in one or more physical activities hosted by Counterstrike Gym. These activities may include but are not limited to: martial arts training, boxing, wrestling, high impact striking and sparring, strength and cardio conditioning, other training of any kind as directed by Benjamin Pettit, Steven Chappel or other trainers affiliated with Counterstrike Gym.

Counterstrike Gym has made me fully aware that the programs offered in which I desire to participate in are of a nature and kind that are extremely hazardous and strenuous. I, the undersigned recognize and understand that the programs/classes are not without varying degrees of risk which may include but are not limited to the following:

1. Injury to the musculoskeletal system                7. Communicable diseases, infections, viruses

2. Injury to the cardio respiratory system                            8. Lost or stolen items or funds

3. Bruises, scratches, cuts, minor abrasions                         9. Self inflicted injuries of any kind

4. Minor or severe sprains, hyperextensons

5. Broken bones, injured joints or ligaments

6. Facial injuries including eyes, nose, mouth, ears

I willingly assume full responsibility for any and all risks that I am exposing myself to as a result of my participation in programs offered by Counterstrike Gym and accept full responsibility for any injury or death that may result from participation in any activity. Hereby certify that I know of no medical problems that may increase my risk of illness or injury as of participation in programs designed by Counterstrike Gym or it’s affiliates.

Release: In full consideration of the above mentioned risks, and in full consideration that I am willingly and voluntarily participating in high risk activities directed by Counterstrike Gym. I hereby waive, release, remise and discharge Counterstrike Gym and it’s agents, officers, principals, employees, affiliates, volunteers, and other members, of any liability, claims, demands, actions or rights of action, or damages of any kind related to, arising from, or connected to my participation in programs offered by South Prospect Gym or its affiliates. This agreement includes all allegations attributed to the negligent acts or omissions of all above mentioned parties. This agreement shall be binding upon me, my successors, representatives, heirs, executors, assigns, attorneys, or transferees.

If I am signing on behalf of a minor, I give full permission for any person connected with Counterstrike Gym to administer first aid deemed necessary, and in case of serious illness or injury, I give permission to call for medical and /or surgical care for the child and to transport the child to a medical facility deemed necessary for the well being of the minor.

Indemnification: I recognize that there is an inherent and unavoidable risk associated with martial arts practice therefore I accept financial responsibility for any injury or illness that I or the participant may cause either to him/herself or to any other participant due to his/her negligence. Should the above mentioned parties or anyone acting on their behalf be required to incur attorney’s fees and costs to enforce this agreement, I agree to reimburse them for such fees and costs. Further agree to indemnify and hold harmless Counterstrike Gym, their principals, agents, affiliates, employees, and volunteers from liability for the injury or death of any persons and damages to property that may result from my negligent or intentional act or omission while participating in activities hosted by Counterstrike Gym.

Photo Release: I grant Counterstrike Gym and its staff the right to film or photograph me during training sessions or other activities involved with its programs. I agree to allow Counterstrike Gym to use such photographs and video for lawful purposes as publicity, advertising, illustration, and online content.

I have read and fully understand the foregoing assumption of risk and release of liability, and I understand that signing it obligates me to indemnify the parties named for any liability for injury or death of any person and damage to property. I understand that by signing this document, waiving valuable legal rights.

Counterstrike Gym Martial Arts Membership Agreement

1. Membership Term and Billing

This is not an extended-term contract. It is a recurring monthly membership agreement. Membership dues are automatically billed each month to the payment method you provide.

2. Pricing and Discounts

Membership price is listed on our enrollment page.

Family or promotional discounts may be applied at the time of enrollment.

Discounts do not apply retroactively after a billing cycle has begun.

3. Late Payments and Fees

Payments more than 5 days late will incur a $30 late fee.

Unpaid balances may be referred to a collection agency.

You agree not to dispute valid membership charges. In the event of a chargeback, the full balance plus late fees may be sent to collections.

4. Attendance and Access

Active membership grants access to all classes in the appropriate age group at both of our locations:

Members may freely attend classes at either location.

Missed classes do not qualify for refunds, credits, or proration.

5. Trial Periods

Membership trials may be canceled at any time before the trial ends.

If a trial is not canceled, it will automatically convert to a paid monthly membership at the standard rate (or applicable discount).

6. Cancellations

Members must submit a 30-day written notice of cancellation.

Cancellation must be completed using Counterstrike Gym’s official cancellation form.

Membership billing will continue during the 30-day notice period.

7. Membership Freezes

Memberships may be frozen at any time as long as you provide a return date.

Memberships will automatically reactivate on the provided return date.

8. Refund Policy

No refunds are issued once a membership charge has been processed.

This includes charges made due to failure to cancel on time or failure to submit the cancellation form.

9. Collection and Chargebacks

Unpaid dues, fees, and chargebacks may be sent to a collection agency.

Member agrees to pay all outstanding balances, late fees, and any additional collection costs.

10. Member Agreement

By signing below, you acknowledge and agree to the following:

You have read, understood, and agree to all terms of this Membership Agreement.

You authorize recurring monthly billing.

You understand there are no refunds after charges are processed.

You understand that cancellations require a 30-day notice via the official cancellation form.

You understand unpaid balances may be referred to collections.
